HireCherry provides a platform that uses generative AI technology to assist HR professionals in screening resumes and evaluating job openings. The AI analyzes the content of resumes and job postings to determine the suitability of candidates for specific positions. While HireCherry strives to provide accurate and reliable assessments, it cannot guarantee the accuracy or completeness of the AI-generated evaluations.

3. Use of Generative AI**

HireCherry employs a generative AI model to automate the resume screening process. By using the Website, you acknowledge and consent to the use of this generative AI to analyze the content of resumes and job openings for the purpose of candidate evaluation. The AI-generated assessments are based on the data provided and may not necessarily reflect the actual qualifications, skills, or abilities of the candidates.

4. User Responsibilities**

You agree to provide accurate and up-to-date information while using the Website. You are solely responsible for the content you submit, including resumes, job openings, and any other information you provide. You understand and agree that HireCherry assumes no responsibility or liability for any inaccuracies or errors in the content you submit.

5. Privacy**

HireCherry takes your privacy seriously. Please refer to our Privacy Policy, which is incorporated into this Agreement by reference, to understand how we collect, use, and disclose your personal information. HireCherry will handle your personal information in compliance with applicable data protection laws and regulations, including but not limited to the General Data Protection Regulation (GDPR) in Europe and the Personal Information Protection and Electronic Documents Act (PIPEDA) in Canada.

6. Intellectual Property**

The Website, including its design, layout, text, graphics, and other content, is owned by or licensed to HireCherry and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Website's content without obtaining prior written permission from HireCherry.

7. Disclaimer of Warranty**

The Website and its services are provided on an "as is" and "as available" basis, without any warranties or representations, express or implied. HireCherry disclaims all warranties, including but not limited to, the accuracy, reliability, or suitability of the AI-generated assessments.

8. Limitation of Liability**

HireCherry and its affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Website or the AI-generated assessments. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses. This limitation of liability applies regardless of the legal theory upon which the claim is based.

9. Modifications to the Agreement**

HireCherry reserves the right to modify, amend, or update this Agreement at any time. Any changes to the Agreement will be effective immediately upon posting on the Website. Your continued use of the Website after the modifications will constitute your acceptance of the revised Agreement.

10. Governing Law and Jurisdiction**

This Agreement shall be governed by and construed in accordance with the laws of the United States. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of the United States.

11. Compliance with Local Laws**

You acknowledge and agree that it is your responsibility to comply with all applicable laws and regulations in the jurisdiction(s) where you use the Website and its services, including but not limited to the data protection and privacy laws of your country.
